1. Agreement to Terms
By accessing and using Redline Futures Funding ("Redline," "we," "us," or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.
These Terms incorporate by reference, and must be read together with, the documents you accept when you create an account and when you receive a funded account: the Trader Agreement, the Risk Disclosure, and the Privacy Policy. When you register, you affirmatively accept the Trader Agreement (which includes a risk acknowledgment and waiver); that acceptance is recorded with a timestamp, version, and IP address and is binding for the life of your account. The Trader Agreement governs the per-account trading, conduct, payout, profit-split, and reset rules summarized in these Terms; where a per-account funded agreement applies to a specific account, that agreement controls for that account. If any conflict exists, the order of precedence is: the account-specific funded agreement, then the Trader Agreement, then these Terms.

11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved individually (and not as a class, collective, or representative action) by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitrator shall have exclusive authority to decide all issues of arbitrability.
Any non-arbitrable claim shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction and venue of those courts. You waive your right to a jury trial. You may opt out of the arbitration and class-waiver provisions by emailing support@redlinefuturesfunding.com within thirty (30) days of first using the Service, with subject “Arbitration Opt-Out”.
11A. California Residents — State-Law Addendum
For users whose primary residence is in the State of California at the time a dispute arises, the following overrides apply to Sections 11 and 12 to the extent California law would otherwise require:
- Choice of law (CoL override). California law governs all claims that California public policy treats as non-waivable, including but not limited to claims under the California Consumers Legal Remedies Act, the Unfair Competition Law (Bus. & Prof. Code § 17200), and the California Privacy Rights Act.
- Public-injunctive relief carve-out (McGill v. Citibank). Notwithstanding the arbitration agreement and class-action waiver above, you retain the right to seek public injunctive relief in a California court of competent jurisdiction. Nothing in this Agreement is intended to waive that right, and any clause that would have that effect is severable as to California residents only, without invalidating the rest of the arbitration agreement.
- Forum. California residents may bring a claim that is not subject to arbitration in either the state or federal courts located in Wyoming or in the California county where they reside.
- Privacy rights. California residents have the rights described in the Privacy Policy, including the right to know, delete, correct, and limit the use of sensitive personal information, and the right to opt out of any sale or sharing of personal information for cross-context behavioral advertising.
12. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall remain in full force and effect, except that if the class-action waiver in Section 11 is found unenforceable, the arbitration agreement shall be null and void and disputes shall instead be resolved in the courts identified in Section 11.
